Forfeiture of the lease was avoided and the tenant’s long lease occupation continues. The landlord’s damages claim, including substantial surveyors and legal costs, was rebuffed as vexatious. The refurbishment works provided an improved environment for the tenant. Tenant expenditure focused on areas of maximum value for occupier.
