For end of lease certainty

Dilapidations are a fundamental part of the relationship between landlord and tenant and usually arise because of the tenant’s failure to meet their repair, decoration or yielding-up liability under the terms of their lease. This poses particular challenges for both parties.

Whether you are an owner or an occupier

We will work with you to formulate the best value exit strategy for your business. Our clients include large retailers, investors, major financial institutions and private property companies. You’ll see below, testimonials from our clients that showcase the value we add to their dilapidations strategies.

Central to our success is our knowledge of the RICS Guidance Note on Dilapidations, the Dilapidations Pre-Action Protocol, current case law and our vast proven experience of negotiating on both sides of the dispute fence.

We also frequently provide Notional Terminal Dilapidations advice where organisations need to make provision for contingent liabilities on their balance sheets.

Our approach to dilapidations

Often claims can be combative, complex and protracted, so where appropriate we reach prompt financial damages settlements, rather than indulge in unnecessary and lengthy negotiation, to achieve the most favourable outcomes for you, whether you’re the landlord or tenant.

Whilst a very rare occurrence, we also have experience in dealing with claims that do not settle by negotiation and progress to litigation.

XPO Logistics has worked with Powell Williams for 10 years. During that time they have supported us with a range of services, and we use them virtually exclusively for dilapidations. Their technical expertise across our varied portfolio along with clear strategic and tactical advice provides us with very positive results. There is a great deal of trust between our team and theirs, which has led to a thoroughly good working relationship.

Powell Williams came recommended for dilapidations and have also assisted us in highlighting areas of a Cat A refit, which were not to standard and specification. There is a significant level of comfort in working with them; and my experience of their approach, professionalism, patience and expertise means that I also highly recommend them to others.

Powell Williams supported us during a large programme of change, involving in excess of 200 properties. The team negotiated multiple terminal dilapidation settlements as well as pre-acquisition surveys and were called upon to travel across the whole of the UK, sometimes at short notice and turn around full reports, in equally short-time. Along with providing dependable results, their flexible approach, speed of response and expertise stands out.
